Who we are

This privacy policy applies to MEDIABLE PTY LTD (ACN 640 390 610) as trustee for The Mediable Trust (ABN 45 736 504 116) - referred to below as "we", "us" and "our".

We publish the website at orsonlord.com and make plugins for DaVinci Resolve, including Snap Animate, Snap Captions and Snap Pod.

We are based in Queensland, Australia.

This policy covers both the website and the plugins. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, which apply nationally across Australia.

The short version

We do not sell your personal information, we do not run advertising, and we do not use advertising or tracking networks.

What we collect, and when

When you visit our website

We use PostHog to understand how the site is used - which pages are read, which links are clicked, and which video or email brought someone here. This records:

• the pages you view and the links you click
• the address of the page or link that sent you here, including any campaign tags on it
• an approximate location derived from your IP address (country and region, not your street)
• your browser, operating system, device type and screen size
• a randomly generated identifier stored in your browser, so that repeat visits from the same browser can be recognised as one visitor rather than several

PostHog also records session replays - a reconstruction of how a page was scrolled and clicked during a visit. These help us find broken layouts and confusing pages. They are not video of you, they do not use your camera or microphone, and they do not capture what you type into fields.

We use Google Search Console to see which search terms bring people to the site. It reports totals only and does not identify individuals.

We do not use Google Analytics. An earlier version of this policy said we might; that has never been the case on this site.

When you buy something

Our plugins are sold through third-party stores that act as the merchant of record - legally, they are the seller:

• Creem - Snap Animate
• Lemon Squeezy - existing and legacy subscriptions
• Ko-fi - free downloads and tips

Your payment details go to them, not to us. We never see, receive or store your card number, and we have no ability to charge your card.

From them we receive what we need to fulfil and support your order: your name, your email address, the country you bought from, the product, an order reference, and your licence key.

When you use our plugins

Our plugins contact our servers in three situations. Two happen automatically; the third only happens if you ask for it.

Licence validation (automatic). To confirm your licence is valid and to count how many machines it is active on, the plugin sends your licence key and an identifier for your device to our validation service, which runs on Amazon Web Services.

Update checks (automatic). The plugin asks whether a newer version is available. This tells us the version you are running and, as with any internet request, your IP address.

Bug reports (only when you send one). Snap Captions 2 can send us a bug report. This is never automatic - it happens only when you choose to submit one. A report includes:

• what you wrote describing the problem
• a technical log of the error
• your licence key
• your email address, only if you choose to enter one. The field is optional and exists so we can reply to you. Leave it blank and the report still reaches us; we simply can't contact you about it
• your DaVinci Resolve project file, only if you choose to attach one. This is also optional. A project file describes your edit - clip names, timeline structure and settings - so please only attach one if you're comfortable sharing it. It helps us reproduce a problem we otherwise can't see

We use bug reports to fix bugs. We do not use them for marketing, and we do not share your project files with anyone.

Our plugins do not track how you use them. There is no usage analytics, no feature tracking and no telemetry inside the software. Nothing about what you edit, what your projects contain, or what your footage is ever leaves your computer.

When you contact us, subscribe, or join our community

• Email - if you email us we keep your address and message so we can help you, and so we have a record if you write again.
• Newsletter - if you subscribe we store your email address in Bento, our email platform, along with whether you opened or clicked. Every email has an unsubscribe link and we act on it.
• Discord - our community server is run by Discord. What you post there is governed by Discord's own privacy policy, and we see it as any other member does.

Cookies

We use cookies for one purpose: analytics. Specifically, PostHog stores a randomly generated identifier so that several page views from the same browser are counted as one visitor and one visit, rather than as many.

We set no advertising cookies, and we belong to no advertising networks.

You can block or delete cookies in your browser settings. The website works normally without them; we simply lose the ability to tell one returning visitor from several new ones.

Who we share information with

We share personal information only with the providers that run parts of our business, and only so far as they need it to do that job.

We may also disclose personal information where we are required to by law.

We do not sell personal information, and we do not disclose it for anyone else's advertising.

We have opted out of allowing PostHog to use our data to train its machine learning models.

Where your information is stored

Several of the providers above are outside Australia - in the United States, the United Kingdom, Estonia and the European Union. Where we disclose personal information to an overseas recipient, we take reasonable steps to ensure they handle it consistently with this policy and the Australian Privacy Principles.

If you are outside Australia

We sell internationally, and residents of some countries - including the European Union and the United Kingdom - have additional rights over their personal information, such as rights to access, correction, erasure, portability, and to object to certain processing.

If you are in one of those countries and would like to exercise those rights, contact us using the details below and we will honour them. We will not ask you to justify the request.

How long we keep information

Marketing

If you subscribe, or buy from us, we may send you product news and updates. Every message includes an unsubscribe link, and unsubscribing takes effect immediately. This is in line with the Spam Act 2003 (Cth).

Security

We take reasonable steps to protect personal information from misuse, loss and unauthorised access. Our systems are password protected, data in transit is encrypted, and access is limited to those who need it.

No system is perfectly secure, and we cannot guarantee the security of information transmitted over the internet.

Accessing, correcting or deleting your information

You can ask us what personal information we hold about you, ask us to correct it, or ask us to delete it. Contact us using the details below. We may need to verify your identity first. We will respond within a reasonable time, and if we cannot do what you have asked, we will explain why.

Note that deleting your purchase record may prevent us from validating your licence or providing support.

Complaints

If you are unhappy with how we have handled your personal information, contact us using the details below and we will investigate and respond.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au. The OAIC is the national privacy regulator and is the correct body for a complaint about a private business, wherever in Australia it is based.

Links to other websites

Our website links to other sites, and our product pages embed videos from YouTube. We are not responsible for the privacy practices of those sites, and we suggest you review their policies.

Governing law

This policy is governed by the law applying in Queensland, Australia, consistent with our Terms and Conditions and our Software and Licence Agreement. Any dispute about it is subject to the exclusive jurisdiction of the courts of Queensland, Australia.

Australian privacy law itself is federal: the Privacy Act 1988 (Cth) and the Australian Privacy Principles apply to us wherever in Australia we are based, and the national regulator is the Office of the Australian Information Commissioner.

This policy is incorporated by reference into our Software and Licence Agreement.

Changes to this policy

We may update this policy. When we do, we will change the "last updated" date at the top and post the new version here.
